ORDER: This writ petition is filed under Article 226 of the Constitution of the India seeking the following reliefs;-
“to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction on the part of the respondents on the petitioner’s Online F-iine Application dt.28.06.2024 submitted for conducting survey and fixation of boundaries for his landed property of Ac.2.96 cents covered by S.No. 228-1, 228-2, 228-3, 229/8 and 230/1 situated at Epurupalem Revenue Village of Chirala Mandal in Bapatia District (Erstwhile Prakasam District) illegal, irregular, irrational, amounts to non-discharge of legal obligation conferred on them under the provisions of Andhra Pradesh Survey and Boundaries Act, 1923 and Board Standing Order 34-A and 34-B of Andhra Pradesh Board of Revenue Standing Orders and offends Articles 14 and 21 of the Constitution of India and consequently direct the respondents 4 and 5 to conduct survey and fix boundaries for the aforesaid land and pass such other

Learned counsel for the petitioner submits that the petitioner filed an F-Line application dated 28.06.2024 seeking for conducting survey and fixation of boundaries in respect of the petitioner’s land admeasuring to an extent of Ac.2.96 cents covered by S.No. 228-1, 228-2, 228-3, 229/8 and 230/1 situated at Epurupalem Revenue Village of Chirala Mandal in Bapatia District. But till date, the
3. 3 -A respondents neither considered the application nor conducted survey. Hence, the present Writ Petition. On the other hand, the learned Assistant Government
4. Pleader for Revenue appearing for the respondents furnished written instructions dated 09.05.2025 issued by the 4*'^ respondent herein, wherein it is stated that;-
“Kurapati Maheswara Venkata Narasimha Rao, S/o. Subba Rao Epurupalem Village, Chirala Mandal has filed applications vide DER 012401506477 and DER 012401506479, dt.28.06.2024 with a request to conduct survey of his land measuring an extent of Ac. 2.96 cents in Sy.No.281/3,228/1,228/2,228/3,228/4, 229/8 230/1 of Epurupalem village. His application was entrusted to the Mandal Surveyor, Chirala and Village Surveyor, Epurupalem III for conducting survey of the land. They have contacted the applicant over phone for conduct of survey. He has informed them that the and land is covered by full of water and not possible to conduct survey and requested to conduct survey after recete of water from the land. Later, he has given a written statement to this effect, the Mandal Surveyor and village Surveyor, Epurupalem III have submitted a report to the Tahsildar, Chirala. But. the petitioner has not turned up and did not informed any thing about the recete of water from the land. After expiry of one month time from the date of filing application in online through mee seva/Village
4 secretariat the application was closed and information goes to the mobile phone of the petitioner. After expiry of one month period also, he has approached the 4*^ respondent or 5*'^ respondent for Survey of his land. Further he has not filed any F-line petition later for survey of his land, contention of the petitioner is not correct. not Flence, the In this connection, it is submitted that the subject lands are near by Kunderu Drain and hence there is water in the land. The petitioner has to take action to let out the water and then file F-line application through proper chancel for survey of the subject lands.

Having regard to the submissions made by the learned counsel for the petitioner and the learned Government Pleader for the respondents and on perusal of the material placed on record, this Court is of the considered opinion the present Writ Petition can be disposed of directing the respondents to consider the F-line application of the petitioner and pass appropriate orders, after providing opportunity of hearing to the parties concerned or if it is in

order conduct survey as per the provisions of Survey and Boundaries Act, 1923, within a period of three (3) months from the date of receipt of copy of this Order. With the above directions, the Writ Petition is disposed of.
7. There shall be no order as to costs. As a sequel miscellaneous application, pending, if any, shall also stand closed.
