The case of the prosecution is that on 10.03.2024, the petitioner, along with the other accused, raised objections against the persons who conducted a rekla race with bullock carts and caused disturbance to public transportation. Therefore, the respondent Police registered a case against the petitioners and others in Crime No.63 of 2024 for the offences under Sections 143 and 341 IPC. After completion of investigation, the final report was filed and the case has been taken on file by the learned District Munsif-cum-Judicial Magistrate, Madathukulam, in S.T.C.No.53 of 2025, which is now sought to be quashed.

Learned counsel appearing for the petitioner submitted that the petitioner/A3, who belongs to a national political party, is a practising advocate and on the alleged date of occurrence, he, along with his colleagues, was only objecting to the conduct of rekla race, which had been prohibited by the Government. However, the Sub-Inspector of Police attached to the respondent Police Station, suo motu, registered a case against the petitioner and his colleagues instead of the persons who attempted to conduct the rekla race. 2/5 https://www.mhc.tn.gov.in/judis

He further submitted that the facts of the instant case are similar to the facts of the cases in Jeevanandham and others vs. The Inspector of Police, Velayuthampalayam Police Station, Karur District reported in (2018 2 LW (Crl) 606) and Sri Raja vs Inspector of Police, Sivakasi Town Police Station Virudhunagar District and others (Crl.O.P No.7922 of 2019, decided on 30.08.2019), in which the proceedings were quashed. Hence, he prayed to quash the proceedings pending against the petitioner/A3.
5. Learned Additional Public Prosecutor appearing for the respondent Police reiterated the prosecution case and endorsed the aforesaid submission.
6. Heard the learned counsel appearing on either side and perused the materials available on record.
7. In view of the above, this Court is of the opinion that the above said decisions would apply on all fours to the present case and that no useful purpose will be served by keeping the proceedings pending and is liable to be quashed. 3/5 https://www.mhc.tn.gov.in/judis

Accordingly, the Criminal Original Petition stands allowed and the proceedings in S.T.C.No.53 of 2025, pending on the file of the learned District Munsif-cum-Judicial Magistrate, Madathukulam. is hereby quashed as against the petitioner.
