Neutral Citation No. - 2025:AHC:17918 Court No. - 76 Case :- WRIT - C No. - 21416 of 2024 Petitioner :- Vandana And Another Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Mohit Gautam Counsel for Respondent :- C.S.C. Hon'ble Vinod Diwakar,J.
1. None appeared on behalf of the petitioners even in the revised call whereas Shri Pramit Kumar Pal, learned Standing Counsel appearing for the State-respondents is present.
2. The petitioners have filed the instant petition seeking protection from the police as they solemnized their marriage without the consent of their parents.
3. On the last day of the hearing, the Court sought a verification report regarding the legitimacy and genuineness of the documents filed along with the petition. Learned Standing Counsel on the basis of instructions stated that the instant writ petition has been filed on the basis of false averments. He further submitted that on police verification it has been revealed that the marriage in question is the third marriage of the petitioner no.2 and this fact has not been disclosed in the writ petition. There is no document on record which could justify the solemnization of the third marriage of the petitioner no.2, therefore, the instant writ petition deserves to be dismissed with costs on the ground of concealment of material facts.
4. This Court is over burdened with the frivolous petitions, in most of the cases either the documents are forged, based on which the
claim has been asserted in the petitions or the petitioners, after filing the writ petitions did not turn up to the Court, in such a situation, the Court has left with no option but to dismiss this kind of misconceived writ petitions with exemplary costs.
5. Accordingly, the writ petition is dismissed with cost of Rs.50,000/- to be deposited by the petitioner no.2-Dinesh Kumar before the District Legal Services Authority, Kasganj, within thirty days from today, failing which, the same shall be recovered as arrears of land revenue within next three months. A copy of the
order be sent to the District Magistrate concerned for record and compliance. The CJM concerned shall ensure the terms of this
order to be complied with in letter and spirit by the State Administration and forward a report in this regard to this Court.
