Choudhury, learned senior counsel, assisted by Mr. S.S. Ahmed, learned counsel for the petitioner and Mr. B. Sarma, learned Addl. P.P. for the State respondent. This application has been preferred by the petitioner namely, Mehbub Ahmed Laskar under Section 483 of Bharatiya Nagarik Suraksha Sanhita Page No.# 2/3 (BNSS), 2023, praying for release on bail, who was arrested on 19.08.2025 in connection with ACB P.S. Case No. 45/2025 under Section 7(a) of Prevention of Corruption Act, 1988. Case diary is received and perused. The learned senior counsel, Mr. H.R.A. Chouddhury has submitted that this being a trap case, it is based almost entirely on documents, which have already been collected. In the premises, the petitioner has already been searched and in the meantime he has spent 31 days in custody and he may be enlarged on bail considering the period of detention and progress of investigation. The learned Addl. P.P., on the other hand, submits that there are sufficient incriminating materials available in the case diary against the petitioner and the bail prayer may not be considered at this stage. Having regard to the submissions of the learned senior counsel for the petitioner and also considering the period of detention and the progress of investigation, further detention of the petitioner may not be necessary for the purpose of investigation. Considering the stage of investigation, the prayer for bail is allowed. Accordingly, it is directed that the petitioner namely Mehbub Ahmed Laskar be released on bail in connection with the aforementioned case, on furnishing a bond of Rs. Rs. 50,000/- (Rupees fifty thousand only) with two sureties each of like amount to the satisfaction of the learned Special Judge, Assam, Guwahati, subject to the following conditions:- (i) That the petitioner shall make himself available for interrogation by the Investigating Officer as and when required; Page No.# 3/3 (ii) That the petitioner shall not, directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or any other police officer, and (iii) That the petitioner shall not hamper with the investigation or tamper with the evidence of the case and shall not leave the jurisdiction of the learned Special Judge, Assam, Guwahati, without prior permission.
