Heard learned counsel for the revisionist, learned AGA for the State and Sri Kanhaiya Lal Tiwari, learned counsel appearing on behalf of opposite party Nos.3 and 4. 2. The instant criminal revision has been preferred against the impugned order dated 18.3.2025 passed by learned Additional Chief Judicial Magistrate-I, Basti in Criminal Misc.Case No.2457 of 2024 (Shambhunath Yadav vs. Awadhesh Singh and others) under Section 173 (4) B.N.S.S., 2023, Police Station-Haraiya, District-Basti. 3. As per the basic allegations in the application under Section 173(4) B.N.S.S., the complaint is filed by Shambhunath Yadav, who himself admitted that he is not the registered owner of the vehicle in question. He submitted that he purchased the said tractor in the name of her mother- Karma Devi. The said tractor was purchased on 20.12.2022 and as per complaint that he made first complaint on 20.7.2024 approximately two years thereafter and thereafter he further filed an application before S.P. Basti on 17.9.2024. The revisionist has himself filed supplementary affidavit where he filed the order passed by District Consumer Forum, Basti. In the said matter, complaint no.239 of 2024, which was decided on 1.7.2025 in favour of Karma Devi. The revisionist had already initiated the civil proceedings on 4.9.2024. After concealment of this fact, he had sent the complaint on 17.9.2024 to S.P. Basti. 4. It is absolutely clear that the matter is purely civil in nature and the Versus Counsel for Revisionist(s) : Rajesh Kumar Dubey, Vivek Yadav Counsel for Opposite Party(s) : G.A., Kanhaiya Lal Tiwari Shambhu Nath Yadav .....Revisionist(s) State Of U.P. And 3 Others .....Opposite Party(s) revisionist is trying to give the colour of criminality. 5. The present revision is having no force, which is liable to be dismissed. 6.
