Heard learned counsel for applicant and learned AGA for the State. 2. The present application has been preferred for seeking quashing of chargesheet dated 28.10.2012 as well as cognizance/summoning order dated 24.01.2013 alongwith entire criminal proceedings of Case No.1160 of 2013 (State Vs. Shah Rizwan and another), arising out of Case Crime No.639 of 2012, under Section 420 IPC, P.S. Sector 39, District Gautam Budh Nagar, pending in the court of learned Chief Judicial Magistrate, Gautam Budh Nagar. 3. At the very outset, learned counsel for applicant apprised the Court that discharge application preferred at the behest of applicant for seeking discharge in the present case, is still pending to be adjudicated before learned court concerned and as such, there is hardly any cause of action surviving for applicant to invoke the inherent jurisdiction of this Court at this stage, particularly when the applicant has already availed an efficacious remedy before learned court concerned, which is yet to be decided and also applicant is already on bail. 4.
