illegality in the order passed by the learned Trial Court on the application filed under Section 126(2) Cr.P.C.
6. So far as fixing of amount as interim maintenance Rs.7000/- per month for each child is concerned, it cannot be said to be illegal or excessive. Since the revisionist has not paid any amount for their maintenance, therefore, it is to be paid from the date of application till the disposal of application under Section 125 Cr.P.C. The revisionist is also working in the Irrigation Department, so it can also not be said that he is not in a position to make payment of aforesaid amount. Thus, there appears no illegality or infirmity in the order dated 1.8.2025 and it does not warrant any interference by this Court. 7. So far as arrears of amount from the date of application is concerned, it shall be paid by the revisionist in twelve equal installments payable month to month with the current amount of interim maintenance. 8. The revision is disposed of accordingly. September 24, 2025 P.P.
