The instant bail application has been filed on behalf of the applicant, Bhanupratap Urf Bhanu, with a prayer to release him on bail in Case Crime No. 120/2023, under Section- 302, 120-B, 34 I.P.C., Police Station - Kagaraul, District- Agra. There are allegations in the F.I.R. against the applicant and 5-6 accused that the informant on 25.07.2023 at about 05:00 a.m. had gone to her agricultural field alongwith her husband, Som Prakash, and father-in-law, Rajendra Singh. There accused persons attacked her husband, Som Prakash, and her brother-in-law, Hem Prakash and caused them injuries by axe and other incised weapons before and died her eyes. Her father-in-law was left in seriously injured condition. Her father-in-law also subsequently, died in the hospital. Earlier also the accused persons had attacked her husband on 05.05.2023, but he escaped. Learned counsel for the applicant submits that the applicant was not present on the scene of incident and was on his duty as per the information given under R.T.I. Learned AGA and learned counsel for informant have vehemently opposed the bail application and they have submitted that it is a case of triple murder. The alibi of the applicant cannot be considered at this stage. This Court after hearing the learned counsels for the parties does not finds any ground for enlarging the applicant on bail at this stage. The bail application is accordingly, rejected. Registrar(Compliance) is directed to communicate this order to the concerned court below within ten days.
