[2025:RJ-JP:27467-DB] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR D.B. Special Appeal Writ No. 572/2025 1. Rohit Kumar S/o Shri Satbir Singh, R/o Gram Ismailapur, T. Kuldeep Meena S/o Chhotu Ram Meena, R/o Shri Ram Ki Nangal, Sanganer, Jaipur, Sitapura Industrial Area, Rajasthan-302022. ----Appellants Versus 1. State Of Rajasthan, Through Its Chief Secretary, Secretariat, Jaipur 2. Rajasthan Public Service Commission, Through Its Secretary, Ajmer, Rajasthan. 3. Department Of Personnel, Government Of Rajasthan Through Its Principal Secretary, Jaipur. 4. Registrar, Rajasthan Cooperative Societies, Rajasthan, Jaipur. ----Respondents For Appellant(s) : Mr. Mohit Khandelwal, Adv. For Respondent(s) : HON'BLE MR. JUSTICE SANJEEV PRAKASH SHARMA HON'BLE MR. JUSTICE CHANDRA PRAKASH SHRIMALI Order 23/07/2025 1. This is an appeal preferred against the order passed by the learned Single Judge dated 16.04.2025. 2. Learned counsel for the appellants submits that Court has adjourned the case vide its order dated 16.04.2025 to be listed on [2025:RJ-JP:27467-DB] (2 of 3) [SAW-572/2025] 15.07.2025 and it did not consider his prayer for grant of interim relief. He submits that interviews have commenced from 21.04.2025 and the appellants ought to have been allowed to participate in the interview. 3. A pointed query was raised to the learned counsel as to whether any such prayer was made by the appellants in their said application to which he fairly admits that no such prayer was made and no such said application was moved. 4. In the aforesaid circumstances, we are, therefore, satisfied that there was no occasion for the learned Single Judge to pass any interim order to allow appellants to appear in the interviews. 5. We also noticed that learned Single Judge has directed the respective counsel of the respondents to file their reply within four weeks and has directed the matter to be listed again giving a particular date. The case is still pending before the learned Single Judge and this appeal has been filed only against an order of adjournment with directions to file reply. 6. The present appeal, in our opinion, is an abuse of process of law and is absolutely frivolous. When the appellants themselves have not moved any application for seeking interim relief, they cannot be allowed to come to an appeal and raise grievance that the learned Single Judge did not grant them interim relief. The facts as stated above were not part of pleadings before learned Single Judge. Appeal has been filed raising scandalous allegations which cannot be accepted. 7. We accordingly, dismiss the present special appeal writ and impose cost of Rs.50,000/- upon the appellants which they shall deposit with the Rajasthan State Legal Services Authority, Jaipur. [2025:RJ-JP:27467-DB] (3 of 3) [SAW-572/2025] 8. It is made clear that if the cost is not deposited, the appellants would not get a right of hearing before the learned Single Judge. 9. All pending application(s), if any, stands disposed. (CHANDRA PRAKASH SHRIMALI),J (SANJEEV PRAKASH SHARMA),J HEENA/MAHIMA/48
