HIGH COURT OF JUDICATURE AT ALLAHABAD PUBLIC INTEREST LITIGATION (PIL) No. - 3000 of 2025 Chief Justice's Court HON'BLE ARUN BHANSALI, CHIEF JUSTICE HON'BLE KSHITIJ SHAILENDRA, J.
1. This petition, purportedly in public interest, has been filed by the petitioner seeking a direction to the respondents not to construct Chhatrapati Shivaji Maharaj Memorial at Kothi Meena Bazar, Agra till the conclusion of the report of Research Committee in the context of Shivaji's history.
2. Submissions have been made that the Government of Maharashtra is proposing to set up a memorial at Kothi Meena Bazar, which is not justified as the said place has no connection with Shivaji Maharaj. Further submissions have been made that instead of said place, Sarai Malikchand is some what connected with Shivaji Maharaj wherein a memorial can be set up.
3. Submissions have been made that a Research Committee be constituted for identifying the place which had connection with Shivaji Maharaj and then only the memorial must be constructed.
4. On a query being put, counsel for the petitioner indicated that the location Kothi Meena Bazar is presently occupied by vendors.
5. Having gone through the petition filed, the reliance which is sought to be placed by the petitioner pertains to a typed written note filed as Versus Counsel for Petitioner(s) : Agam Jain, Akash Pandey, Aklank Kumar Jain Counsel for Respondent(s) : A.S.G.I., C.S.C., Manoj Kumar Singh, Pooja Singh Civil Society of Agra through its Secretary Sri Anil Sharma .....Petitioner(s) Union of India through its Ministry of Culture and 5 others .....Respondent(s)
Annexure-1, authenticity whereof and its origin, is not known, which is claimed to be authored by one Professor Sugam Anand, based on the fact that the said aspect is indicated by hand on the said note.
6. Filing of PILs, based on unauthentic material and seeking to question the respondents with regard to the action which is still proposed to be taken, cannot be countenanced.
7. Besides the above, the very fact that the location in question is occupied by vendors, also appears to be a reason for filing the petition. The PIL apparently has no substance and the same is, therefore, dismissed. October 15, 2025 Sandeep/AKShukla WPIL No. 3000 of 2025 2 (Kshitij Shailendra,J.) (Arun Bhansali,CJ.)
