Learned counsel for the applicants argued that the accused-applicants are innocent. They have been falsely implicated in this very case crime number and are languishing in jail since 01.09.2025. Learned counsel for the applicants submit that similarly circumstanced co-accused Mubariq and Musariq, have already been enlarged on bail by this Court as well as a coordinate Bench of this Court in Criminal Misc. Bail Application Nos. 34815 of 2025 and 33394 of 2025, vide orders dated 10.10.2025 and 26.09.2025, respectively. Criminal antecedent of one case has already been explained in paragraph no. 3 of the supplementary affidavit, whereas the applicant no. 2 has no criminal antecedents and there is no likelihood of their fleeing from course of justice or tampering with evidence in case of release on bail. Hence, bail has been prayed for. Per contra learned A.G.A. has opposed the prayer for bail of the applicants, but could not dispute the fact that similarly circumstanced aforesaid co-accused have already been granted bail. Considering all above facts and circumstances, the nature of accusations, severity of the punishment in the case of conviction and nature of Versus Counsel for Applicant(s) : Mohd.
