Verma, Additional Advocate Generals with Mr. Ravi Chauhan, Deputy Advocate General. ____________________________________________________ Sandeep Sharma, Judge(oral): Petitioner herein, who at present is working as Assistant Professor (Geography) at Government Degree College, Banjar, District Kullu, Himachal Pradesh, has approached this Court in the instant proceedings, seeking therein direction to the respondents to consider and decide his pending representation dated 13.06.2025 (Annexure P-1), whereby he has prayed for his transfer from afore station to GDC Joginder Nagar, where one post of Assistant Professor (Geography) is lying vacant on account of fact that his wife Smt. Ranjana Devi, who has been working as Forest Range Officer at 1Whether the reporters of the local papers may be allowed to see the judgment? 2 Forest Range Banjar under Forest Division Seraj, has been recently transferred to Forest Range Bir under Forest Division Palampur, District Kangra, Himachal Pradesh. 2. In nutshell, case of the petitioner is that in terms of Transfer Policy formulated by the Government of Himachal Pradesh, he and his wife should be posted at the same or nearby stations so that their family life does not get disturbed. 3. Having regard to the nature of prayer and order proposed to be passed in the instant petition, this Court sees no necessity to call for the reply from the respondents, who are otherwise represented by Mr. Ravi Chauhan, learned Deputy Advocate General. Mr. Chauhan, states that since petitioner has not completed normal tenure at present place of posting, coupled with the fact that he otherwise being Class-I Officer is liable to be posted anywhere in the State of Himachal Pradesh, prayer made on behalf of the petitioner deserves outright rejection. 4. Having carefully perused averments contained in the petition, which are duly supported by an affidavit, this Court finds that both the petitioner and his wife, Smt. Ranjana Devi, are in Government service.
Prior to issuance of order dated 13.01.2025, wife of the petitioner namely Smt. Ranjana Devi was working as Forest Range Officer in Forest Division Seraj and petitioner was
3 posted at Government Degree College, Banjar, District Kullu, Himachal Pradesh, meaning thereby, they both were living together. Now on account of transfer of the wife of the petitioner to Palampur, which is far away from Seraj, coupled with the fact that Transfer Policy formulated by the Government of Himachal Pradesh, enables an employee to seek transfer/adjustment at a convenient station on the ground of couple case, petitioner at first instance approached Government for doing the needful, but since no response was received, he has approached this Court in the instant proceedings. 4. Consequently, in view of the above, this Court, without going into the merits of the case, deems it fit to dispose of the present petition with a direction to the respondents to consider and decide the pending representation of the petitioner (Annexure P-1) expeditiously, preferably within a period of three weeks from today. Ordered accordingly. Needless to say, authority concerned, while doing the needful in terms of instant order, shall afford an opportunity of being heard to the petitioner and pass appropriate orders taking note of Transfer Policy, which certainly enables an employee to seek transfer/adjustment at a convenient station on the ground of couple case.
