HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW SPECIAL APPEAL No. - 200 of 2013 Court No. - 1 HON'BLE RAJAN ROY, J. HON'BLE RAJEEV BHARTI, J. 1. Heard learned Additional Chief Standing Counsel for the State- appellants and learned counsel for the respondent. 2. This is an appeal, which was filed in 2013, challenging a judgment and order dated 09.10.2012 passed in Writ Petition No. 1948 (S/S) of 1993. 3. The respondent-petitioner was appointed on the post of Collection Amin in 1988 on the basis of his qualification of Madhyama. His services were terminated on 26.02.1993 on the ground that qualification of Madhyama was not equivalent to Intermediate and was not recognized as such. There was an interim order operating during pendency of the writ petition in pursuance to which the respondent-petitioner continued in service. The writ petition was ultimately allowed on 09.10.2012. Learned Single Judge opined that the termination order was passed in 1993 based on some directions of the State Government regarding non equivalence of the degree-diploma provided by the Hindi Sahitya Sammelan, Allahabad i.e. Madhyama but by then, the petitioner who was inducted in service in 1986 had put in six years of service and in view of the interim order passed by the writ Court on 12.03.1993 he had continued in service and had also attained the age of superannuation, therefore, learned Single Judge was of the opinion that it would not be appropriate to decide the controversy on merits. At the time of filing of the writ petition in 1993 the respondent-petitioner was 39 years of age. Versus Counsel for Appellant(s) : C.S.C. Counsel for Respondent(s) : S.C.Srivastava, Riyaz Ahmad State Of U.P.Throu.Prin.Secy.Deptt.Of Revenue Lko.And Ors. .....Appellant(s) Chandraveer Singh .....Respondent(s) 4. Looking into the scenario presented before us, as, the respondent- petitioner retired way back in 2012 it is too late in the day to interfere with the judgment of the writ Court, especially as, he must be receiving retiral benefits for the past almost 13 years. 5. The special appeal is dismissed. November 18, 2025 R.K.P. SPLA No. 200 of 2013 2 (Rajeev Bharti,J.) (Rajan Roy,J.)
