The prayer of petitioner in the writ petition is as under:- “(i) For direction upon respondents to consider the claim of the petitioner for his promotion on Grade-3 i.e. Matric Trained Selection Grade w.e.f. 01.04.2012 as the petitioner fulfills all criteria for grant of Grade 3 which is completion of 12 years of service from the date of Grade-2 but respondents are sitting tight over the matter whereas same has been granted to other similarly situated persons. (ii) Upon grant of above benefits for further direction upon respondent authorities to pay all monetary benefits including the arears of salary and revision of pension and other retiral dues.” 3. It is a case of the petitioner since the petitioner has completed 12 years of service in Grade-2, he is entitled for Grade- 3 scale. He also submits that the similarly situated Teachers have been granted the said benefits but the petitioner has been left out 2025:JHHC:23473 2 for the reasons that the petitioner has not approached the Court. He also submits that the petitioner names find place in the Gradation List also, thus he entitled for the relief. 4. Learned counsel for the respondents submits that if the petitioner file a representation annexing all the documents before respondent No.3-the Director, Primary Education, School Education and Literacy Department, Govt. of Jharkhand, his case will be considered and if it is found that the petitioner he is entitled for the benefits, the same will be extended to him including payment of the arrears. 5. Considering the said submission, I direct the petitioner to file a detailed representation annexing copy of all the documents which the petitioner is relying upon, before the Director, Primary Education, School Education and Literacy Department, Govt. of Jharkhand respondent No.3 within four weeks from today. On receipt of the said representation, will take a decision on the same within six weeks. If the petitioner is entitled to the same, the same will be granted to him within four weeks thereafter. 6.
