This application has been preferred by the petitioner namely, Tukheswar Das under Section 483 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, praying for release on bail, who was arrested on 18.07.2025 in connection with Pulibor P.S. Case No. 95/2025 (G.R. Case No. 562/2025) under Sections 20(b)(ii)/B/25 of NDPS Act, 1985. As per instruction received by the learned Addl. Public Prosecutor, charge
Page No.# 2/2 sheet has not yet been submitted in this case. The case is registered under Sections 20(b)(ii)/B/25 of NDPS Act, which pertains to intermediate quantity. The petitioner has already completed the statutory period of 60 days in custody and the petitioner is entitled to be released on bail. Accordingly, it is directed that the petitioner namely Tukheswar Das be released on bail in connection with the aforementioned case, on furnishing a bond of Rs. Rs. 20,000/- (Rupees twenty thousand only) with two sureties each of like amount to the satisfaction of the learned Special Judge (NDPS), Jorhat, subject to the following conditions:- (i) That the petitioner shall make himself available for interrogation by the Investigating Officer as and when required; (ii) That the petitioner shall not, directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or any other police officer, and (iii) That the petitioner shall not hamper with the investigation or tamper with the evidence of the case and shall not leave the jurisdiction of the learned Special Judge (NDPS), Jorhat, without prior permission.
