Neutral Citation No. - 2025:AHC:22382 Court No. - 4 Case :- MATTERS UNDER ARTICLE 227 No. - 1520 of 2025 Petitioner :- Smt. Santosh Kumari Rathore Alias Munni Respondent :- Bhagwati Prasad Rathore And Another Counsel for Petitioner :- Rahul Saxena Counsel for Respondent :- Arun Kumar,Sanjeet Kumar Dubey Hon'ble Ajit Kumar,J. Heard Sri Rahul Saxena, learned counsel for the petitioner as well as Sri Sanjeet Kumar Dubey, learned counsel for the respondent development authority. After some argument, learned counsel for the petitioner submits that the petitioner is confining her petition to prayer no. (ii).
Learned counsel for the respondent does not have any objection, if prayer is granted for expeditious disposal of pending Revision No. 247 of 2024 arising out of an order passed by the executing court rejecting objection filed by the development authority under Section 47 of C.P.C. In view of the above, this petition stands disposed of with a direction to the District Judge, Kanpur to decide the pending Revision No. 247 of 2024 as expeditiously as possible preferably within a period of two months from the date of receipt of certified copy of this order. It is, however, clarified that in the event District Judge concerned is not able to decide the revision for any technical reason, such delay in disposal of the revision and pendency thereof shall ordinarily not be a ground sufficient enough to fasten the officer concerned with any personal liability of contempt.
