HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW APPLICATION U/S 482 No. - 9795 of 2025 Court No. - 14 HON'BLE RAJEEV SINGH, J.
1. Heard learned counsel for the applicant and learned A.G.A. for the State. 2. This application has been filed with the following prayer:-
"To quash the entire proceedings of Sessions Trial No.3051 of 2023 (State Versus Anoop Singh alias Rishabh Singh) arising out of Case Crime No.359 of 2023 under sections- 323, 342, 376, 506 I.P.С., relating to the Police Station- Mandiyaon, District- Lucknow, pending in the Court of learned Additional District and Sessions Judge/F.T.C.-II, Lucknow, as well as impugned chargesheet dated 23.8.2023 submitted by the Investigating Officer against the petitioner, under sections- 323, 342, 376, 506 I.P.C., in aforesaid Case Crime No.359 of 2023."
3. Learned counsel for the applicant submits that the applicant and the victim of the present case were in friendship. It is further submitted that as per the prosecution case, the victim and the applicant made physical relations on the pretext of marriage. It is next submitted that the victim was already married, hence, her allegations are not correct, but this fact was not examined by the Investigating Officer and then the charge-sheet was submitted. Relying on the judgment of Hon'ble Supreme Court in the case of Jaspal Singh Kaural Vs. State of N.C.T. of Delhi reported in S.L.P. (Crl.) No. 4007 of 2024, learned counsel for the applicant submits that allegedly, Versus Counsel for Applicant(s) : Anuja Bajpai Counsel for Opposite Party(s) : G.A. Anoop Singh @ Rishabh .....Applicant(s) State Of U.P. Thru. Prin. Secy. Home Deptt. Lko. And Another .....Opposite Party(s)
assurance is given to a married lady for marriage by the accused and this story is completely hypothetical, hence, indulgence of this Court is required. 4. Learned A.G.A. vehemently opposes the prayer of the applicant and submits that as per the prosecution case, the applicant and the victim were in friendship prior to two years of marriage of the victim and after her marriage, she requested the applicant not to interfere in her married life, but he was visiting her in-law's house frequently and asked the victim to join his company and life threat was also given to her; certain intimate photographs were also shown by the applicant to the victim's in-laws, as a result, her in-laws ousted her.
He also submits that the judgment relied by the applicant's counsel is not applicable in the present case and the statement of the victim has already been recorded before learned trial Court, hence, no interference is required at this stage. 5. Considering the submissions of learned counsel for the parties and perusing the record, it is evident that the judgment relied by the applicant's counsel is not applicable in the present case and the statement of the victim has already been recorded before the trial Court. Therefore, no interference is required at this stage. 6. With the above observations, the application, being misconceived, is dismissed.
