No.12786 OF 2025 THE HONOURABLE SRI JUSTICE SUBHENDU SAMANTA WRIT PETITION No. 12786 of 2025 ORDER: The petitioner approached this Court alleging inaction on the part of the police authority, for not registering a crime in pursuance to his compliant dated 20.03.2025. 2. Written instructions of Respondent-Authority reveals that they have received the compliant dated 20.03.2026, but after preliminary enquiry, it is found to the police that the allegation leveled by the petitioner is incorrect and baseless. 3. Learned counsel for the petitioner raises objection against action of the action of the police authority and their instructions. He submits that there are several materials to register a crime for offence of criminal intimidation. I make it clear that the compliant as placed before this Court cannot be dealt with by High Court, at this juncture, but, the matter may be properly dealt with and cognizance may be taken according to the law, by jurisdictional Magistrate concerned, if he found sufficient materials thereof. 4. Let this matter be relegated to the learned magistrate for taking appropriate action. Petitioner is at liberty to lodge the complaint before the learned Magistrate according to law. If the petitioner is able to lodge private complaint to the learned Magistrate within two (2) weeks, the learned W.P. No.12786 OF 2025 magistrate concerned shall accept the same and take appropriate action according to law. 5. This instant writ petition is disposed of. There shall be no order as to costs.
