HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. WRIT PETITION No. - 10541 of 2025 Court No. - 11 HON'BLE ABDUL MOIN, J. HON'BLE MRS. BABITA RANI, J. 1. Heard learned counsel for petitioners and learned A.G.A. for respondent no.1 to 3. 2. In view of the order proposed to be passed, notice to respondent no.4 is hereby dispensed with. 3. By means of this writ petition, petitioner prays for quashing of the First Information Report dated 29.10.2025, bearing Case Crime No.0606 of 2025, under Sections 87, 352, 351(3) of B.N.S. 2023, Police Station-Mauranva, District-Unnao. 4. Contention of learned counsel for petitioners is that respondent no.4 has lodged the impugned F.I.R. alleging that his daughter has eloped with one Sri Gangadeen in which the petitioners have also assisted. Upon the complainant having asked the petitioners about the whereabouts of his daughter, they have abused and beaten the complainant. The contention is that once the daughter of respondent no.4 is an adult and gone on her own with one Sri Gangadeen, there can not be any occasion for the petitioners to have been named in the F.I.R. under the aforesaid provision of B.N.S. 2023. 5. Learned A.G.A. states that investigation in this case is still going on and neither the daughter of respondent no.4 nor Sri Gangadeen have been traced out till date. 6. Considering the aforesaid and the fact that the investigation is still Versus Counsel for Petitioner(s) : Anand Awasthi, Anjani Kumar Srivastava Counsel for Respondent(s) : G.A. Kiran Devi Alias Kiran And Others .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Home Deptt. Lko. And Others .....Respondent(s) continuing the writ petition is disposed of with the direction to the respondent authorities to not take any coercive action against the petitioners unless they have some cogent and credible evidence against the petitioners. 7. Needless to mention that the petitioners shall cooperate in the investigation. In case of non-compliance, benefit of this order would not be available to petitioners.
