By the present writ petition, the petitioner, who is the son of late Uma Singh Marko who was working in the School Education Department as a Headmaster at Middle School Marwahi, District: Gaurela-Pendra-Marwahi died on 18/07/2022, is seeking a direction towards the respondents authorities to decide the application for grant of compassionate appointment. 2. Learned counsel for the petitioner submits that the petitioner has submitted an application for grant of compassionate appointment in view of death of his mother before the Block Education Officer on 12/06/2024. However, the said application has not been forwarded to the competent authority i.e. District Education Officer. He further submits that the petitioner has also requested the District Education Officer vide representation Annexure P-8 dated 09/04/2025, however, till date, neither the application for compassionate appointment has been forwarded nor the District Education Officer has decided the representation submitted by the petitioner. 3. Learned counsel for the State submits that if the application Annexure P-8 is still pending before the D.E.O., the same shall be considered in accordance with law within a stipulated period. 4. I have heard learned counsel for the parties, perused the pleadings and document. 5. Looking to the submission made by learned counsel for the 3 petitioner that the petitioner has already submitted an application for grant of compassionate appointment before the B.E.O. on 12/06/2024 and the same has not been forwarded to the D.E.O. who is the competent authority and the petitioner has already approached before the District Education Officer vide Annexure P-8 dated 09/04/2025, the writ petition is disposed of with a direction to the District Education Officer to decide the representation of the petitioner dated 09/04/2025 and look into the grievance raised by the petitioner, in accordance with law within a period of 40 days from today. 6. With the aforesaid observation and direction, the writ petition stands disposed of. The petitioner is at liberty to apprise the the District Education Officer about the order of this Court.
