Learned AGA, on instructions, submits that the Tahasildar on enquiry has come to the conclusion that the petitioner was ineligible for being considered as an unauthorized occupant and as therefore, forwarded the papers along with recommendation to the Deputy commissioner for rejection of the petitioner's claim. - 3 - NC: 2025:KHC:9960 WP No. 6326 of 2025 3. In the light of the said statement, it is clear that the claim of the petitioner has been considered and steps have been taken by the concerned Tahasildar and therefore, the prayer of the petitioner would not survive for consideration. 4. However, it is made clear that in the event the Deputy commissioner accepts the recommendation of the Tahasildar and holds that the petitioner was ineligible to be considered as unauthorized occupant and the unauthorized occupation was to be regularized, petitioner would be at liberty to challenge the said order of the Deputy Commissioner.
