GP FOR MINES AND GEOLOGY The Court Made the Following Order:- This Writ Petition under Article 226 of the Constitution of India is filed for the following relief: “to issue a WRIT OF MANDAMUS or any other appropriate writ order or direction declaring the action of the respondents 2 to 6 in not considering the representation dated 19.03.2025 of the petitioner seeking to revoke and cancel the mining lease with an extent of 13 000 Hectares 32 5 Acres Govt Land in Sy 2 No 129 of Singareddypalli Village Seetharamapuram Mandal SPSR Nellore District in favour of Respondents no 7 to 9 as illegal arbitrary and unconstitutional arbitrary colourable exercise of power and violative of Art 21 of the constitution of India and consequently direct the respondents 2 to 6 immediately take steps to cancel the mining lease granted in favour of the Respondents no 7 to 9 with an extent of 13 000 Hectares 32 5 Acres Govt Land in Sy No 129 of Singareddypalli Village Seetharamapuram Mandal SPSR Nellore District to pass...” 2. Heard learned counsel for the petitioner and the learned Assistant Government Pleader for Mines and Geology. Perused the record. 3. The petitioner herein is a resident of Plot No. 105, 2nd Floor, Devi Garden Apartment, Opposite Velangini School, Mulapeta, Nellore. The submission of the learned counsel for the petitioner is that the Quarry Lease for Quartz, Feldspar, and Mica over an extent of 13.000 hectares (32.5 acres) of government land in Sy.No. 129 of Singareddypalli Village, Seetharamapuram Mandal, SPSR Nellore District, granted in favour of respondent No. 7, expired long back. Despite the same, respondent Nos. 7 to 9 are allegedly carrying out illegal mining operations on the subject land, and the official respondents have neither revoked or cancelled the quarry license nor made any effort to conduct an auction to allot the mining lease to other eligible parties. Thereupon, the petitioner herein made a representation, dated 19.03.2025, to the official respondents without including the Union of India and other competent authorities. Therefore, the learned counsel for the petitioner seeks permission of this Court to withdrawn the 3 present Writ Petition with a liberty to make a fresh representation by including the Union of India and other competent authorities. 4. In view of the aforesaid facts and circumstances of the matter, the petitioner herein is permitted to make a fresh representation to the official respondents including Union of India and other statutory authorities within a period of two (2) weeks from the date of receipt of a copy of this order. On such representation, the concerned authorities are directed to pass appropriate speaking orders within a period of two (2) weeks thereon, in accordance with law. 5. With the above direction, the Writ Petition is disposed of. No costs.
