Heard learned counsel for the appellant and Sri Shivam Sharma, learned counsel for the respondent no. 4-BSA Rae Bareli. 2. G.O. dated 07.10.2010 apart from containing other conditions contains clause 4 as under:- (4 ) कु ल कायăरत िशWȋ की संćया- उनके नाम के शैिWक व ŠिशWण योĈयता, उनकी िवǯालय मȅ िनयुिǘ की ितथ का िववरण उपलĜध करायȅ। िनयुǘ हेतु िनधाăिरत ŠिŌया से सĞबिęधत समĥत अिभलेख भी उपलĜध करायȅ। 3. The order which was impugned before the writ court categorically mentions as under:- (3) िजला बेिसक िशWा अिधकारी, रायबरेली एवं सहायक िशWा िनदेशक (बे०) लखनऊ अĘयापक अनुमोिदत नहȂ है, न ही इन अĘयापकȋ की िनयुिǘ की ŠिŌया के कोई अिभलेख उपलĜध कराये गये हȈ तथा Ōमांक -3 से 6 पर अंिकत सं०अ० अŠिशिWत दशाăए गये हȈ। उǘ सं०अ० उǥर Šदेश माęयता ŠाĚत बेिसक ĥकू ल (जूिनयर हाई ĥकू ल)( अĘयापकȋ की भतȃ और सेवा की शतȇ) िनयमावली , 1978 " के िनयम 4 मȅ उिġलिखत स०अ० हेतु िनधाăिरत ŠिशWण अहăताधारी नही है। उǘ से ĥपǸ है िक इन अĘयापकȋ की िनयुिǘ करने मȅ िवǯालय के Šबęधतंś DZारा " उǥर Šदेश माęयता ŠाĚत बेिसक ĥकू ल ( जूिनयर हाई ĥकू ल) (अĘयापकȋ की भतȃ और सेवा की शतȇ) िनयमावली, 1978 " के िनयमȋ मȅ िनधाăिरत ŠिŌया नहȂ अपनाई गई है। अतः समĥत अĘयापकȋ की िनयुिǘ अिनयिमत है। 4. After considering relevant facts and documents the order goes on to state as under:- Versus Counsel for Appellant(s) : Rajendra Pratap Singh Counsel for Respondent(s) : C.S.C., Shivam Sharma C/M Janta Vidyalaya Junior High School Thru. Manager Sri Kant Singh Bhadauriya .....Appellant(s) State Of U.P. Prin. Secy. Basic Edu. Lko And 3 Others .....Respondent(s) C (ख) ũी ओम Šकाश िसह की पिरचारक पद पर िवǯालय मȅ कायăभार Ŏहण की ितिथ 02.08.2006 एवं ũी उदय Šताप िसह की पिरचारक पद पर िवǯालय मȅ पूवă से िदनांक 04.07.97 DZारा कायăरत िदखाया गया है। शासनादेश िदनांक 02.07.90 DZारा अशासकीय माęयता ŠाĚत िवǯालयȋ मȅ चतुथă ũेणी का एक पद सृिजत िकया गया है। उǘ शासनादेश के Ōम मȅ िनगăत शासनादेश िदनांक 14.09.90 मȅ उġलेख िकया गया है िक पुराने माęयता ŠाĚत िवǯालयȋ मȅ पहले से कायăरत चतुथă ũेणी कमȃ जैसे-जैसे सेवािनवृǥ होते जायȅगे अथवा वह पद अęय Šकार से िरकात हो जायेगा, वैसे-वैसे एक पर छोíकर शेष पदȋ पर िनयुिǘ नही की जायेगी, परęतु संबंिधत िवǯालय के Šबęधतंś DZारा उǘ शासनादेश िदनांक 02.07.99 का उġलंघन करते ɷए एक अितिरǘ पिरचारक की िनयुिǘ कर दी गयी। उपरोǘ से ĥपǸ है िक इन कमăचािरयȋ की िनयुिǘ करने मȅ िवǯालय के Šबęधतंś DZारा " उ०Š० माęयता ŠाĚत बेिसक ĥकू ल (जू०हा०ĥकू ल) ( िलिपक वगă कमăचारी तथा समूह- घ के कमăचारीयȋ की भतȃ एवं सेवा की शतȇ) िनयमावली, 1984" मȅ िनधाăिरत ŠिŌया नहȂ अपनाई गयी है। अतः इनकी िनयुिǘयां अिनयिमत हȈ। 5. It clearly says that appointment of all the teachers and other staff is illegal. The Single Judge has categorically noted that there is no denial of this fact in the entire writ petition with regard to the procedure adopted for appointment of most of the teachers as has been stated in the impugned order. We asked the learned counsel for the appellant to kindly demonstrate from the writ petition any averment therein that all the teachers and staff were validly appointed as also the procedure which may have been followed for their appointment, whether any documents were annexed in support thereof, no such averment could be pointed out. 6. Therefore, in these circumstances we fail to understand that how in an intra court appeal we can interfere with the impugned judgment even assuming that the institution is otherwise a category-A institution and not a category-B institution. 7. The relevant conditions for being taken on grant in aid not being satisfied, the impugned order was passed which was assailed but the Single Judge for the reasons given in the impugned judgment has disposed of the writ petition, rightly so. 8.
