GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the inaction of the 5th rOespondent (who was appointed as a Special Officer by the 2nd respondent in pursuance of the Contempt Proceedings in C.C.No. 94/2017 in W.P.No. 2 28692/2016) in completing the investigation in Cr. No.125 / 2016 on the file of the Kothapeta Police Station, Guntur Urban, Guntur District even after the elapse of five (5) years from the date of registration of crime and elapse of four (4) years from the date of taking charge by the 5th respondent contrary to the stipulated time observed by this Hon'ble Court is as illegal, arbitrary and contrary to the fundamental rights enshrined under the Constitution and consequently direct the 5th respondent to complete the investigation in Cr. No.125 / 2016 on the file of the Kothapeta Police Station, Guntur Urban, Guntur District within a stipulated time and further direct the 2nd respondent to supervise or super see the investigation in FIR No. 125/2016 on the file of the Kothapeta Police Station, Guntur Urban, Guntur District.” 2. Sri G.Kondala Rao, learned counsel for the Petitioner would submit that Crime No.125 of 2016 has been registered by the SHO, Kothapet Police Station, Guntur Urban for the offences under Sections 448, 341 and 420 read with 34 IPC. Learned counsel would further submit that the Police have not finalized the investigation in the said crime till date. 3. Sri V.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that investigation in the said crime is almost completed and for want of some documents, they have not filed charge sheet. 4. Considering the submissions made, the Writ Petition is disposed of directing the Respondents - Police to conclude the investigation in Crime No.125 of 2016 of Kothapet Police Station, Guntur Urban, and file a report in accordance with law, within a period of two weeks from the date of receipt of copy of this order. There shall be no order as to costs.
