The petitioner has filed this petition praying for following relief:- “It is therefore, prayed that this Hon'ble Court may kindly be pleased to allow the petition and quash the entire proceeding of Criminal Case No. 2141/2023 with Charge Sheet dated 30.04.2024 pending before the learned Judicial Magistrate First Class Bilaspur District Bilaspur (CG) which arise out of the FIR bearing No. 28 of 2022 for the offence punishable U/s 294, 323, 325, 506, 34 of IPC registered at Police Station City Kotwali District Bilaspur (CG), challan no. 63 of 2023 submitted before the competent court of law on 27.02.2023 against the present applicants in the interest of justice.” 4. On a pointed query being made to the learned counsel for the petitioners that though the cognizance has already been taken and charges have already been framed by the concerned trial Court, as to why she has not challenged the same, she could not give any satisfactory explanation. 5. In view of the same, learned counsel for the petitioners prays to withdraw the present petition with liberty to file afresh. 6. Accordingly, this petition is dismissed as withdrawn, with liberty to file petition afresh, subject to depositing a sum of Rs.2,000/- as cost by the petitioners in the Registry of this Court within a period of one week from today, and the same shall be transmitted to the Government School for Visual and Hearing Impaired, Tifra, District- Bilaspur (C.G.). 3 7.
