This anticipatory bail application under Section 438 and 440 Cr.P.C., has been preferred by the petitioner apprehending his arrest in connection with Kanke P.S. Case No.205 of 2023, for offences under Sections 420, 427, 506 & 120B IPC. The case is presently pending before the Court of learned Chief Judicial Magistrate, Ranchi.

Learned A.P.P. representing the State opposes the prayer for anticipatory bail.

From the impugned order and the materials on record, I don’t find anything which would remotely suggest that there is an eminent threat of the petitioner being arrested.

Thus, I am not inclined to pass any order in this case. In future, if any material surfaces to arrest the petitioner, it is expected that the guidelines given by the Hon’ble Supreme Court in the case of Arnesh Kumar Vs. State of Bihar & Anr. reported in (2014) 8 SCC 273, Satender Kumar Antil vs. Central

Bureau of Investigation & Another, reported in 2022 (10) SCC 51 as well as Satender Kumar Antil vs. Central Bureau of Investigation & Another, reported in 2024 (9) SCC 198, will be strictly followed so far as this petitioner is concerned.

It will be open to the petitioner to appear before the Court below and pray for regular bail.

Accordingly, this Anticipatory Bail Application stands
