Page No.# 2/3 Suraskha Sanhita, 2023, whereby the accused petitioner namely, Haren Nath, has prayed for bail in connection with Laharighat P.S. Case No. 136/2025, under Section 107/118(2)/3(5)/342 of BNS, 2023. 3. The learned counsel for the petitioner submits that the present case lodged against the present petitioner and others, is a counterblast of the FIR lodged by the petitioner against the informant in this case. The allegation in the present case lodged by Ms. Dipali Bhuyan is that the victim was assaulted by the accused persons named in the FIR dated 23.05.2025 lodged by Dipali Bhuyan. 4. Learned Additional Public Prosecutor for the State has placed the case diary along with medical report and submits that the injury sustained by the victim is simple in nature. However, abrasion found in the neck of the injured person named Rakesh Nath. In the forwarding report, at the time of arrest of present petitioner, the allegation about sexual assault made by the side of the accused persons has been stated to be false and fabricated. 5. I have seen the progress of investigation. The learned counsel for the petitioner submits that the petitioner is a physically challenged person, drawing attention to the disability certificate annexed as Annexure 5. In the same, it is stated that the petitioner is 60% disabled due to a road accident. Investigation is not yet completed. Considering the facts noticed above, I hold that perhaps, he can be released on bail at this stage, subject to conditions. 6. Accordingly, the accused-petitioner, named above, shall be released on bail in connection with Laharighat P.S. Case No. 136/2025, under Section 107/118(2)/3(5)/342 of BNS, 2023, on furnishing bail bond of Rs.25,000/- with one suitable surety of the like amount to the satisfaction of learned concerned court. 7. The direction for bail is further subject to the following conditions: (a) That the petitioner shall be available for trial; (b) That the petitioner shall not hamper or tamper with evidence; and (c) shall not intimidate or harass the informant/victim side, in any manner. 8. Violation or breach of any condition(s) shall entail cancellation of bail. 9.
With the above observations, this bail petition stands allowed and
disposed of accordingly.
