The grievance of the petitioner in the instant writ petition is against the action of the respondents in including the petitioner’s agricultural land of an extent of Ac.4.80 cents in Sy.No.481-3 situated at Andagundala Village, Tada Mandal, Tirupati District, in the list of prohibited properties under Section 22- A(1)(a) of the Registration Act, 1908 (hereinafter referred to as ‘the Act’). 3. It is contended that the petitioner purchased the subject property in the year 2014 under a registered sale deed bearing Document No.6610 of 2014 dated 30.07.2014. The subject property was initially assigned in favour of Ex- servicemen under the Ex-servicemen quota in the year 2000. Subsequently, in terms of G.O.Ms.No.1117 dated 11.11.1993, the original assignee transferred the said land in favour of the petitioner by way of a registered sale deed. After recognizing the petitioner’s possession and enjoyment over the subject property, the revenue authorities mutated the petitioner’s name in the revenue records. Since then, the petitioner has been in peaceful possession and enjoyment of the subject property. 4. However, the subject property was included in the list of prohibited properties under Section 22-A(1)(a) of the Act. The petitioner had submitted an application dated 09.01.2023 before the 2nd respondent seeking deletion of the subject property from the list of prohibited properties under Section 22- A(1)(a) of the Act. 5.
On the basis of the said application, the 2nd respondent called for reports from the 4th and 5th respondents. The 5th respondent submitted a

report recommending deletion of the subject property from prohibitory list prepared under Section 22-A of the Act and forwarded the same to the 2nd respondent through the 4th respondent. The petitioner was also informed of the said recommendation. However, despite receipt of the said report, no further orders have been passed by the authorities. 6. Learned counsel for the petitioner further submits that, the 3rd respondent, vide proceedings in Roc.No.E1/e-43720/2025 dated 20.05.2025, called for a further report from the 4th respondent. Yet, no final orders have been passed. 7. Today, when the matter was taken up for consideration, the learned Assistant Government Pleader for Revenue has placed before the Court a copy of the written remarks received by her from the 5th respondent, dated
04.09.2025. A perusal of the same would reflect that, pursuant to the instructions of the Collector, the petitioner was requested to furnish copies of the Identity Card, Pension Card, DKT Patta, and discharge certificate of her husband from service. It is further stated that upon furnishing of the said documents by the petitioner, appropriate orders would be passed. However, the petitioner has not submitted the said documents. 8. In reply, learned counsel for the petitioner submits that no such letter was received by the petitioner to furnish any documents whatsoever, as contended by the respondents. He further submits that the petitioner is ready to submit the said documents before the 5th respondent and seeks a direction

to the respondents to receive the same and pass appropriate orders at the earliest. Learned counsel further submits that even the written instructions do not disclose that any notice was served upon the petitioner calling for production of the documents. 9. The written remarks of the 5th respondent dated 04.09.2025 are placed on record. 10.
Having regard to the submissions made, this Court deems it appropriate to dispose of the writ petition granting liberty to the petitioner to submit copies of the Identity Card, Pension Card, DKT Patta, and discharge certificate of the petitioner’s husband from the service before the 5th respondent within a period of four (04) weeks from the date of receipt of a copy of this order. Upon such submission, the 5th respondent shall forward the same to the 2nd respondent and thereafter, the 2nd respondent shall consider the application dated 09.01.2023 of the petitioner and pass appropriate orders, in accordance with law, within a period of two (02) months thereafter. 11. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.
