JUSTICE SHAMIMA JAHAN ORDER Date : 05.09.2025 Heard Mr. S Hoque, learned counsel for the petitioner. Also heard Mr. P Borthakur, learned Additional Public Prosecutor for the State of Assam. By this application, the petitioner has sought for bail in connection with Bongaigaon P.S Case No. 187/2025 registered under Section 305(b)/112 of B.N.S, 2023. The F.I.R dated 21.07.2025 reveals that a motorcycle bearing registration No. AS- Page No.# 2/3 16-G-3773 was stolen from the parking area at Bageshwari Temple gate and an F.I.R was lodged in view of the same. Mr. S Hoque, learned counsel for the petitioner submits that the petitioner is in no way involved in the said offence and that his name had surfaced during the investigation and the forwarding report also does not show his involvement in the offence, however, his name was arrayed as accused No. 5 in the said forwarding report. Mr. P Borthakur, learned Additional Public Prosecutor for the State of Assam, however, submits that the investigation is on and during investigation, it was found out that one Amit Kumar, who was involved in multiple cases had sold it to one Hafiz Habjur Rahman and that other persons are also involved in the said transaction. Upon consideration of the submissions made by the parties and on perusal of the F.I.R and the forwarding report, this Court deems it fit to release the petitioner on bail on furnishing of a bail bond of Rs. 30,000/- with 1(one) local surety of the like amount to the satisfaction of the Court of Ld. C.J.M, Bongaigaon under the following conditions : The petitioner shall cooperate with the investigation and appear before the I/O as and when called for. The petitioner shall not tamper with the evidence or influence the witnesses connected with the case. The petitioner shall not leave his place of residence without the permission of the Court of Ld.
