Court No. - 80 Case :- APPLICATION U/S 529 BNSS No. - 245 of 2025 Applicant :- Arvind Narain Singh Opposite Party :- State of U.P. and Another Counsel for Applicant :- Vinod Kumar Singh Counsel for Opposite Party :- G.A. Hon'ble Nalin Kumar Srivastava,J. 1. Heard learned counsel for the applicant and learned A.G.A. for the State are present. 2. This application under Section 529 BNSS has been filed with a prayer to direct the court concerned to expedite the Case No.45 of 2013, arising out of Case Crime No.119 of 2012, under Sections 419, 420, 467, 468, 471 I.P.C. (State Vs. Arvind Narain Singh), Police Station Nagra, District Ballia, pending in the court of learned Chief Judicial Magistrate, Ballia, expeditiously within a stipulated period. 3. It is submitted by learned counsel for the applicant that this case pertains to the year 2012. It is further submitted that the final report was submitted by the police and protest petition is pending. The applicant before this Court wants early disposal of the protest petition. 4. I have considered the submissions and perused the entire record. 5. It reveals from the perusal of the record, that the final report was submitted by the police in this case twice and now after submitting the second final report, the protest petition was moved by the informant which is pending for disposal. Since the applicant before this Court is one of the accused, he has got no locus standi to move this application for the expeditious disposal of the final report rather it is prerogative for the informant that if the informant is not appearing or not cooperating with the trial court for the disposal of the protest petition, the learned trial court is free to pass any adverse order. 6. With the above observations, the application stands disposed of. Order Date :- 8.4.2025 Shivangi Digitally signed by :- SHIVANGI YADAV High Court of Judicature at Allahabad
