The present application under Section 528 of BNSS has been filed by the applicant Mohd. Ahmad with the prayers to direct the investigating officer to provide the opportunity to the applicant to produce and submit his evidence and witnesses as well as taking into consideration during the course of investigation and provide the opportunity of hearing in case crime No. 215 of 2023, Sessions Case No. 809 of 2024 (State Vs. Manoj Kumar Patel and others), under Sections 419, 420, 467, 468, 471, 120-B IPC and Section 8/13 Prevention of Corruption Act and Section 12 Passport Act, P.S. Khalilabad, District Sant Kabir Nagar, pending before Additional District Judge/Special Judge (P.C. Act), Court No.5, Gorakhpur and with a further prayer to direct the investigating office to complete the investigation in accordance with law of the aforesaid case. 4. At the very outset, learned counsel for the applicant submits that the present application under Section 528 BNSS be dismissed as not pressed as he intends to file a better petition. 5.
