ORDER Date : 18 .09. 2025 Heard Mr. N.J. Dutta, learned counsel for the petitioner and Mr. P.S. Lahkar, learned Addl. P.P. for the State respondent. This application has been preferred by the petitioner namely, Mantu Ali under Section 483 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, praying for release on bail, who was arrested on 22.07.2025 in connection with
Page No.# 2/3 Mukalmua P.S. Case No. 183/2024 under Sections 22(b)/29 of the NDPS Act. As per allegation, 9 bottles of cough syrup was recovered from the petitioner, which pertains to intermediate quantity. Although, there are materials against the petitioner in the case diary, the accused has already spent 58 days in custody and he is almost on the varge of completing the statutory period of detention. Considering the above, it is directed that the petitioner namely Mantu Ali be released on bail in connection with the aforementioned case, on furnishing a bond of Rs. Rs. 50,000/- (Rupees fifty thousand only) with two sureties each of like amount to the satisfaction of the learned Special Judge (NDPS), Nalbari subject to the following conditions:-
(1) That the petitioner shall make himself available for interrogation by the Investigating Officer as and when required; (2) That the petitioner shall not, directly or indirectly make any inducement, threat or promise to any person acquainted with the
facts of the case so as to dissuade him from disclosing such facts to the Court or any other police officer, and (3) That the petitioner shall not hamper with the investigation or tamper with the evidence of the case and shall not leave the jurisdiction of the learned Special Judge (NDPS), Nalbari without prior permission.
With the above directions, this bail application stands disposed of.
