At the very outset, Sri Ram Shyam Shanker Pandey, learned counsel for the writ petitioner seeks to withdraw the present petition, wherein the challenge has been raised to issue a writ, order or direction in the nature of mandamus commanding to the respondents to pay minimum of the pay scale to the petitioner in the light of judgment passed by the Hon'ble Supreme Court in the Shobha Shankar Dubey case, with liberty to file afresh, as according to him, the present petition has not properly been constituted. Learned counsel for the respondents have no objection to the same. The writ petition is dismissed as withdrawn with liberty aforesaid.
