Das, learned counsel for the petitioner. Also heard Mr. H. Gupta, learned CGC for the respondent. Page No.# 2/2 As per the earlier order dated 02.05.2025, Mr. M.K. Bhattacharjee, retired District and Sessions Judge, Assam, was appointed as a prospective arbitrator, subject to furnishing the written declaration as required under Section 12(1) of the Arbitration and Conciliation Act, 1996. The said written declaration has been furnished and is placed on record, marked as ‘X’, dated 17.05.2025. The learned prospective arbitrator has not expressed any difficulty in continuing with the arbitration. In view of the written declaration being received, the order dated 02.05.2025, whereby Mr. M.K. Bhattacharjee, retired District and Sessions Judge, Assam, was appointed as a prospective arbitrator, is hereby confirmed. Accordingly, Mr. M.K. Bhattacharjee is appointed as the sole arbitrator to arbitrate and decide the disputes arising between the parties in connection with the execution of the construction work allotted to the petitioner for the New Broad Gauge Railway Line from Jiribam to Imphal. The parties shall appear before the learned Arbitrator appointed by this Court within four (4) weeks from today, along with a certified copy of this order. A copy of this order shall also be communicated to the learned arbitrator appointed by the Court by the Registry.
