2. This application under Section 483 of BNSS, 2023 has been filed by the petitioner, namely, 1. Syed Sahid Ali @ Sahid Ali, seeking regular bail in connection with All Women P.S Case No.
74/2025
under
Sections 69/74/77/78/79/351(2)/351(3)/319 of BNS, 2023. 3. The case arose out of an ejahar dated 26.08.2025, lodged an FIR by the informant Gargi Phukan before the Officer-In- Charge, All Women Police Station, Panbazar. 4. The elaborate narration in the FIR, in a nutshell, is that the informant developed some kind of relationship with the accused, who had falsified his identity. 5. Apart from that aspect, what is more significant, prima- facie from the FIR is that he allegedly started threatening to make some private photographs and videos viral, causing tremendous agony to the informant. She has also alleged about being harassed by his family members. The accused was stated to have been arrested on 26.08.2025. 6. The learned counsel for the petitioner seeks bail, contending that he has also been custodially examined and that he shall abide by any conditions imposed. 7. The learned Additional P.P for the State, opposing the bail, draws my attention to the statement of the alleged woman recorded before the learned JMFC during investigation. The said statement is also elaborate and corroborates her allegations in the FIR. 8. Considering the nature of the allegations, the statement
Page No.# 3/3 before the Magistrate and the projected apprehensions and threats stated to have been faced by the informant - it might be prudent to allow the investigation to proceed further, instead of granting bail to the accused at this stage. In such a view, the bail petition stands rejected at this stage. 9. Return back the case diary. 10.
