Applicant has approached this Court through this petition under Article 226 of the Constitution of India for issuance of directions to the respondent no.2- Sub- Divisional Magistrate, Tehsil- Madiyahun, District Jaunpur, to expedite and decide the proceedings of Case No.09/2023, Computer Case No.T202314360605232, titled Ramesh Chandra Mishra Vs. Siyaram Upadhyay and others situated in Mauja- Khuawanva, Pargana Barsathi, Police Station Barsathi, Tehsil Madiyahun, District Jaunpur, under Section 133 Cr.P.C., in a stipulated period. Learned counsel for applicant has submitted that petitioner has given an application along with affidavit on 11.10.2023 before the respondent no.2, but the subject case is still pending adjudication and is not making any headway. Learned counsel for applicant prays that in view of the nature of the offence, it would be in the interest of justice, if directions are issued to the respondent no.2 to decide the above mentioned case in a specific time frame. Concededly, the procedure for subject trial prescribed under the Code of Criminal Procedure is summary in nature, therefore, this Court is not inclined to issue any direction to give preference to this case, in the light of the decision of Hon'ble Supreme Court in the case of High Court Bar Association, Allahabad vs. State of U.P. and others (Special Leave Petition (Crl.) Nos. 13284-13289 of 2023. Dismissed.
