Neutral Citation No. - 2025:AHC:23110-DB Court No. - 3 Case :- WRIT - C No. - 4541 of 2025 Petitioner :- Shoaib Qureshi Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Amit Singh Counsel for Respondent :- C.S.C.,Surnedra Prasad Shukla Hon'ble Anjani Kumar Mishra,J. Hon'ble Jayant Banerji,J. 1. Heard learned counsel for the petitioner and learned counsel appearing for the respondent Nos. 3 and 4. 2. Challenge in the writ petition is to a tender notice dated 20.12.2024. 3. The petitioner furnished his bid. Since only one bid namely that of the petitioner was received, it appears that the respondents published a second notice on 15.01.2025. The petitioner again furnished his bid. 4. Learned counsel for the petitioner submits that this bid was accepted but has subsequently been cancelled and a fresh auction notice was issued. 5. He also admits that even consequent to the second tender notice, the petitioner was the sole bidder. 6. He further submits that his bid was wrongly rejected after having been accepted once, on the ground that certain documents had not been uploaded along with the bid which were mandatorily required. 7. Be that as it may, it is not in dispute that the bid of the petitioner was the sole bid which has been rejected, for whatever reason. 8. The object of an auction is to ensure wide participation and for this reason alone, non-acceptance of a single bid consequent to a public notice inviting tenders resulting in its cancellation cannot be said to be vitiated in any manner. Competitive bidding is resorted to, so as to obtain and to select the most responsive bid. 9. For the same reason, we do not find it a fit case for interference. 10. The writ petition is accordingly, dismissed.
