Neutral Citation No. - 2025:AHC:21616-DB Court No. - 3 Case :- WRIT - C No. - 4320 of 2025 Petitioner :- Amit Kumar Singh Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Kailash Nath Singh Counsel for Respondent :- Bhupendra Kumar Tripathi,C.S.C.,Gaurav Kumar Chaturvedi Hon'ble Anjani Kumar Mishra,J. Hon'ble Jayant Banerji,J. Heard learned counsel for the petitioner and learned counsel appearing for respondent no.3, Nagar Palika Parishad, Shahganj, District Jaunpur. Challenge in this writ petition is order dated 30.09.2023 passed by respondent no.2/Collector, Jaunpur whereby the State has resumed the plot no.2813 having an area 0-12 decimal for construction of Material Recovery Facility Center. Only contention of the learned counsel for the petitioner is that although the land in question was recorded as banjar but village is under consolidation operations. Be that as it may, learned counsel for the petitioner has not been able to show any provision of law where-under the State cannot resume the land vested in the gaon sabha for the purpose of management. Only contention is that this land is situated adjacent to the house. In any case abadi is not subject matter of consolidation operation even during currency of consolidation operations. It is only agricultural land which is subject matter of consolidation matter. Under the circumstances, the petitioner has no right or interest in the matter. The writ petition is accordingly dismissed. Order Date :- 14.2.2025 Asha Digitally signed by :- ASHA High Court of Judicature at Allahabad
