Heard learned counsel for petitioner and learned State counsel for opposite parties. 2. The present petition has been filed seeking the following main relief:- "(i). Issue a writ, order or direction in the nature of Mandamus, directing the Opposite Party no.2 / Executive Engineer, Provincial Division, Public Works Department, District - Raibareli to pay the Gratuity and Family Pension amount of Rs. 1,58,436/- along with other benefits to the Petitioner." 3. Learned counsel for petitioner submits that aforesaid dues pertained to service rendered by petitioner's father late Jagannath who passed away on 20.03.2006. 4. Since consideration of petitioner's grievance would entail factual aspects, without entering into merits of the case, liberty is granted to petitioner to file a fresh representation before opposite party No.2 i.e. Executive Engineer, Versus Counsel for Petitioner(s) : Suresh Kumar Yadav, Poonam Counsel for Respondent(s) : C.S.C. Sant Ram .....Petitioner(s) State Of U.P. Thru. Prin. Secy., P.W.D., Lko And Another .....Respondent(s) Provincial Division, Public Works Department, Raibareli. In case such a representation is filed, the same shall be decided within a period of eight weeks from the date a certified copy of this order is produced before the said authority. 5.
