HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - A No. - 14503 of 2025 Court No. - 7 HON'BLE MANISH MATHUR, J. 1. Heard learned counsel for petitioner and Mr. Ashwini Kumar Singh Rathore learned State Counsel for opposite parties. 2. Petition has been filed challenging order dated 28th October 2025 whereby notice has been issued pertaining to superannuation of petitioner on 31st December 2025. 3. Learned State Counsel has raised a preliminary objection regarding entertainability of this petition in view of the fact that the impugned order is only in the nature of a superannuation notice since petitioner would be attaining the age of superannuation of 62 years as on 31st December 2025. 4. Learned counsel for petitioner has not been able to demonstrate by any statutory provision, rules, regulations or any circular of government order that petitioner’s contractual services as a Technical Assistant can be continued beyond a period of 62 years of age. 5. In view of aforesaid, there does not appear to be any occasion to grant any indulgence. The petition, therefore, fails and is dismissed at the admission stage itself. Parties to bear their own costs.
