This application has been filed under section 483 of the Bharatiya Nagarik Page No.# 2/3 Suraskha Sanhita, 2023, whereby the accused petitioner namely, Jonali Talukdar, has prayed for bail in connection with Nalbari P.S. Case No. 202/2025 under Section 103(1)/117(2)/329(3)/3(5) of BNS, 2023. 3. The allegation is about the present petitioner and her husband that trespassing the house of the informant and assaulted the informant’s husband resulting serious injuries and subsequently death. 4. It is submitted by the learned counsel for the petitioner that initially, the petitioner was not arrested; however, she was subsequently arrested during the course of the investigation. It is also submitted that the present petitioner has a six years child and suffering from some ailments. It is further submitted that the petitioner is in under trial detention since 20.08.2025. 5. The learned Additional Public Prosecutor for the State submits that in the meantime the investigation is completed and charge sheet has been submitted. He has raised objection against the prayer of the petitioner. 6. Perused the annexed medical documents. Despite the seriousness of the alleged offences and the present petitioner being charge sheeted – considering the completion of investigation and the difficulties of the minor child of the present accused – she can be released on bail at this stage, subject to conditions. 7. Accordingly, the accused-petitioner, named above, shall be released on bail in connection with Nalbari P.S. Case No. 202/2025 under Section 103(1)/117(2)/329(3)/3(5) of BNS, 2023, on furnishing bail bond of Rs.25,000/- with one suitable surety of the like amount to the satisfaction of learned concerned court. Page No.# 3/3 8. The direction for bail is further subject to the conditions: (a) That the petitioner shall be available for trial; and (b) That the petitioner shall not hamper or tamper with evidence. 9. Violation or breach of any condition(s) shall entail cancellation of bail. 10. With the above observations, this bail petition stands allowed and disposed of accordingly. JUDGE Comparing Assistant
