No.91, Koduru Village, Makavarapalem Mandal, contending 2 that the same has been issued without considering the representation of the petitioner dated 07.03.2025. 3. It is stated that the petitioner was granted lease hold rights in respect of the subject land in a public auction conducted on 10.01.2022 for a period of two years, commencing from 01.01.2022 to 31.01.2025, on annual lease of Rs.18,000/-. Upon entering into the lease, the petitioner raised a casuarina plantation, which is not yet ready for harvesting. Thus, the petitioner made a representation to the 5th respondent requesting an extension of the lease period for a period of three years. However, without considering the same, the petitioner was asked to vacate the subject land, and an auction notification was issued proposing to conduct an auction on 09.05.2025 for a period of six years with effect from 2025-2026 to 2030-2031. It is contended that the issuance of the public auction notice for a period of six years is arbitrary and is not in accordance with the Rules. 4. When the matter was taken up for admission, Sri Sivaram, the learned counsel appearing for the petitioner, sought a direction to the respondents to extend the existing lease for a further three years since the petitioner had invested in the existing plantation on the leasehold land. The learned counsel further stated that the petitioner is willing to pay enhanced lease rent, if the existing term is extended. 3 5. Accordingly, the petitioner filed an undertaking affidavit dated 09.05.2025 to the said effect, agreeing to pay an enhanced lease amount of 50% over the existing lease amount. 6. Accordingly, the writ petition is disposed of with a direction to the respondents to extend the lease period of the petitioner for a further period of three years with effect from 2025-2026, subject to the undertaking given by the petitioner in the affidavit dated 09.05.2025. It is made clear that the petitioner shall hand over vacant possession of the subject land upon the expiry of the lease period of three years with effect from 2025-2026. There shall be no order as to costs.
