2025:JHHC:19911 IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No.3876 of 2025 ------ Mihir Joseph @ Felix Joseph Marandi, S/o Martin Joseph Marandi. … … Petitioner Versus The State of Jharkhand. … … Opposite Party ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Peter Martin T.J., Advocate For the State : Mr. Bishambhar Shastri, A.P.P. ----- 04/ 21.07.2025 Heard the parties. 2. This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest in connection with Korrah P.S. Case No.149 of 2023, for offence under Section 394 IPC. The case is presently pending before the Court of learned A.C.J.M., Hazaribagh. 3. There is an allegation that this petitioner and others have assaulted the informant. 4. During the course of argument, it has been submitted by the petitioner’s counsel that one of the accused was put on trial and ultimately was acquitted. 5. Learned A.P.P. representing the State opposes the prayer for anticipatory bail. 6. After hearing the parties and going through the impugned order, I find that it has come in the impugned order that the petitioner is trying to misuse the process of law and is also evading his arrest. 7. The aforesaid fact is substantiated from the conduct of 2025:JHHC:19911 the petitioner as he has filed this anticipatory bail only after one of the co-accused has been acquitted in the trial. 8. Considering the nature of allegation and the fact that the petitioner has assaulted the informant and also considering his conduct, I am not inclined to allow this application. 9. Accordingly, this Anticipatory Bail Application stands dismissed. (ANANDA SEN, J.) Prashant. Cp-3
