The petition coming on for hearing, upon perusing the petition and the memorandum of grounds filed in support thereof and upon hearing the arguments of Sri KADIYAM NEELAKANTESWARA RAO, Advocate for the Petitioner and of PUBLIC PROSECUTOR for Respondent, the Court made the following ORDER TCDS,J CrI.P.No.5387 of 2025 The Court made the following ORDER: The present Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, by the petitioner/accused No.2 for granting of antiCiPatOry bail in COnneCtiOn with crime No.145 of 2025 on the file of the Prohibition & Excise station, Rajamahendravaram South, East Godavari District, registered for the offences punishable under Sections 7-B r/w 8-B of the Andhra Pradesh Prohibition (Amendment) Act, 2020. 2. It is the case of{he prosecution that, On 12.03.2025 at about 8.15 a.m., on receipt Of Cred®Ible infOrmat'lOn, the Prohibition and Excise Inspector, Rajamahendravaram South along with his staff and mediators reached near wambay houses in Veerabhadra Nagar of Rajamahendravaram urban Mandal and conducted raid at the br'ldge at 100 feet road and noticed One female person standing With mica hand bag, who tried to escape from the place by leaving her mica hand bag, then the police stopped her and questioned about contents in the mica hand hag, for which she stated that the bag contains lD Liquor. The raid party verified the mica hand bag and found 20 Ltrs of lD Liquor in 04 polythene covers, each POlythene cover containing about o5 Ltrs of lD Liquor (04XO5-20 Ltrs) with strong llD Liquor smell. On question'Ing about her Particulars, She `.--I i, seisr .I ,--a i `+ TCDS,I CrI.P.No.5387 of 2025 disclosed her name as fPolisetti Laxmi/Accused No.1' and stated that she purchased the above lD Liquor from accused No.2/petitioner herein for selling at higher price. The police arrested accused No.1 and seized the contraband under the cover of mediator report. 3. On the other hand, learned counsel for the petitioner would submit that the petitioner is not present at the scene of offence and he was falsely implicated in the said crime. He would further submit that the petitioner did not commit. any offence as alleged and he is the sole breadwinner of the family and requested to allow the present criminal petition. 4. Per contra, learned Assistant Public Prosecutor opposed the bail application on the ground that the petitioner is a habitual offender and in the event of his release on bail, it tis very difficult {o secure his Presence. 5. Having considered the submissions made by both the learned counsel, this Court is inclined to a[]ow the present criminal petition with the fo[[owing conditions: i) In the event of arrest of the petitioner/accused No.2, the petitioner shall be enlarged on bail on executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only), with two sureties each for like sum to the satisfaction of the Prohibition and Excise -z~, t`-i r` I.; •{?.
