HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - C No. - 10793 of 2025 Court No. - 3 HON'BLE SHEKHAR B. SARAF, J.
HON'BLE PRASHANT KUMAR, J.
1. Heard learned counsel appearing on behalf of the petitioner and the learned Standing Counsel appearing on behalf of the State. 2. This is a writ petition under Article 226 of the Constitution of India, wherein the petitioner is aggrieved by the actions of respondent Nos.2 to 5 with regard to alleged illegal dispossession of the petitioner's land. 3. Learned counsel appearing on behalf of the petitioner submits that he is being prevented from raising construction under the land, i.e., Gata No.690. 4. This submission of learned counsel for the petitioner is vehemently opposed by learned counsel appearing on behalf of the State and the Gaon Sabha, who have categorically submitted that nobody is preventing the petitioner from carrying out construction in his own property. They also rely on the order dated 26.06.2025 passed by the SDM. The relevant portion of which is delineated herein-below:-
Versus Counsel for Petitioner(s) : Wazhul Qamar, Mehdi Khan, Premkant Counsel for Respondent(s) : C.S.C., Dilip Kumar Pandey Mohd. Karim .....Petitioner(s) State Of U.P Thru. Prin. Secy. Revenue Deptt. Govt. Lko. And 6 Others .....Respondent(s)
5. It appears that the petitioner himself was trying to encroach upon the land that was not belonging to him and accordingly, the SDM had passed the said order. 6. In light of the same, we direct that respondent Nos.2 to 5 shall not interfere in the possession of the petitioner's Gata No.690. However, in the event the petitioner tries to encroach upon the land that does not belong to the petitioner, a suitable action may be taken by the respondents authorities in accordance with law. 7. With the above direction, the writ petition is disposed of.
