HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - C No. - 12197 of 2025 Court No. - 5 HON'BLE ALOK MATHUR, J. 1. Heard Sri Pankaj Kumar Tiwari, learned counsel for the petitioners as well as learned Standing Counsel for respondent nos. 1 to 5. 2. By means of present writ petition the petitioners have assailed three different orders passed under Section 67 of the U.P. Revenue Code, 2006 pertaining to all the three petitioners individually. Merely because all three petitioners have raised construction over the same fragment of land being Gata No. 1297Kh, area 1.7360 hectares, situated at Village - Pure Bhawan, Pargana and Tehsil - Sadar, District - Raebareily, cannot leave them to tile solitary petition where cause of action to each of the petitioners is separate and distinct. 3. The petitioners have not disputed the fact that separate notices under Form 19 and 20 were issued to the petitioners, who have filed their objections and merely because the impugned orders have been passed on the same date, single petition has been preferred. There is no doubt with regard to the fact that separate writ petition has to be filed for separate cause of action and in the present case separate cause of action has arisen to each of the petitioner individually to assail the orders of eviction and imposition of penalty, passed under Section 67 of the U.P. Revenue Code, 2006. 4. For the aforesaid reasons, present writ petition is dismissed at the very threshhold, giving liberty to the petitioners to file separate writ petitions Versus Counsel for Petitioner(s) : Pankaj Kumar Tiwari Counsel for Respondent(s) : C.S.C., Dilip Kumar Pandey Shiv Mohan Yadav And Others .....Petitioner(s) State Of U.P. Thru. Addl. Chief Secy. Deptt. Of Revenue, Lko. And Others .....Respondent(s) individually with regard to grievance raised by them in the present writ petition. 5. Office is directed to return certified copy of the impugned order(s) to learned counsel for the petitioner as per law. December 16, 2025 A. Verma WRIC No. 12197 of 2025 2 (Alok Mathur,J.)
