JUSTICE BISWAJIT PALIT =O=R=D=E=R= 15/05/2025 Petitioner in pro bono capacity seeks issuance of a writ of quo warranto questioning the appointment of the respondents No.5 to 8 alleging that they lack eligibility criteria as per the Minimum Qualification for Teachers in Pharmacy Institutions Regulations, 2014 framed by the Pharmacy Council of India. Petitioner also alleges that as per the RIPSAT notification dated 01.03.2013, the private respondents lack eligibility to be promoted as Professors in the Regional Institute of Pharmaceutical Science and Technology (RIPSAT). However, the instant writ petition has been styled as a public interest litigation. It has by now been settled that service matter disputes cannot be entertained as public interest litigation. Petitioner can always seek writ of quo warranto in a writ petition under Article 226 of the Constitution of India. The instant writ petition being styled as public interest litigation is therefore not entertainable before the Division Bench of this Court. Mr. Arijit Bhaumik, learned counsel for the petitioner, therefore, seeks permission to correct the nomenclature of the writ petition and also the description of respondent No.4 which should be Regional Institute of Pharmaceutical Science and Technology (RIPSAT) through the Principal in-Charge instead of what has been described therein. Let it be done during course of the day. Mr. K. De, learned Additional Government Advocate appears for the respondent-State. Mr. Somik Deb, learned senior counsel submits that he would be entering appearance on behalf of the respondent No.6. Be that as it may, list the matter before the appropriate Bench after necessary corrections are made out with a fresh institution number.
