f THE HONOURABLE SRI JUSTICE VENKATESWARLU NIMMAGADDA / A CIVIL REVISION PETITION NO: 1260 OF 2025
ORDER: The present revision is filed seeking to expedite the Execution Proceedings vide E.P.No. 144 of 2018 in A.S.No.73 of 2016 in O.S.No.589 of 2012 on the file of the Court of the III Additional Civil Judge, (Junior Division), Kadapa.
2. When the matter is taken up for hearing, learned counsel for the petitioner requested this Court to issue a direction to the Court below to dispose of the E.P.No. 144 of 2018 in A.S.No.73 of 2016 in O.S.No.589 of 2012 on the file of the Court of the III Additional Civil Judge, (Junior Division), Kadapa filed under Order 21, Rule 11 C.P.C.
3. In “Bhoj Raj Garg v. Goyal Education And Wehare Society and wherein the Hon’ble Supreme Court has categorically held as n1 Others follows:
“execution proceedings within six months from the date of filing, which can be extended only by recording reasons in writing for such delay, this direction is meant to be observed. This would mean that every effort should be made to dispose of the execution petition within the said time limit and the Execution Court should have reasons for not being able to dispose of the execution petition. The Execution Court is duty bound to record reasons in writing when it is unable to dispose of the matter". 1 2022 LiveLaw SC 976
4. In view of the submissions made and taking into consideration the observation in the Judgment referred to supra, this Court is of the considered opinion that the present revision petition can be disposed of with similar lines as held by the Hon’ble Apex Court as extracted supra. Hence, the Court below is directed to dispose of the E.P.No. 144 of 2018 in A.S.No.73 of 2016 in O.S.No.589 of 2012 on the file of the Court of the III Additional Civil Judge (Junior Division), Kadapa, on merits, as expeditiously as possible, preferably within six (06) months from the date of receipt of a copy of this order. .
5. With the above direction, the C.R.P is disposed of. There shall be no
order as to costs.
