JUSTICE PRANJAL DAS ORDER Date : 19.09.2025 1. Heard Mr. S. Hoque, learned counsel appearing for the accused petitioner as well as Mr. P. Borthakur, learned Addl. P.P., Assam appearing for the State respondent. 2. This petition under Section 483 of the BNSS, 2023 has been filed by the Page No.# 2/3 accused-petitioner, namely, Mohor Ali @ Muhar Ali praying for grant of bail in connection with Barama P.S. Case No.61/2025 under Sections 310(2) of BNS Act. 3. The allegation in the FIR dated 16.07.2025 is dacoity of a truck bearing registration No. RJ09QE6232 carrying pan masala of Rs.80 lakhs. 4. It is submitted by the learned counsel for the petitioner that the alleged stolen property has been recovered. Present accused was arrested along with several other persons at Jorabhat near Guwahati. 5. Mr. D. P. Goswami, learned Additional Public Prosecutor submits that case diary has been received and the implications against the present accused is by way of incriminating statements of the co-accused about his involvement with this offence. He fairly submits that upon perusal of the case diary he did not notice other incriminating material against the present accused and no specific details have also been mentioned about him about being a habitual offender. However, he objects the bail prayer of the petitioner. 6. Considering the aforesaid facts and circumstances and also the fact that the accused is in detention since 23.07.2025 – it is provided that the accused petitioner, named above, shall be released on bail of Rs.30,000/- each with one sui table surety of like amount each to the satisfaction of learned concerned court subject to the following conditions that the petitioners: (a) shall not abscond. (a) shall co-operate with the remaining investigation. (b) Shall not hamper or tamper with the evidence. Page No.# 3/3 (d) shall not misuse his liberty to commit any illegal act or offence. 7.
