Present applicant has shown his grievance against the order dated 12.11.2024 whereby recovery warrant has been issued against him in pursuance of the order dated 26.02.2024 whereby interim maintenance has been granted to the wife. Record reveals that order dated 26.02.2024 has already been assailed before this Court by resorting to remedy of filing a revision being Criminal Revision (Defective) No.1383 of 2024 (Sanjay Kumar Sonkar v. State of UP and Another). In the aforesaid revision, notices were ordered to be issued on the delay condonation application. In view of the proceeding resorted to by the present applicant against the order dated 26.02.2024, it would not be befitting to grant any interim relief to the present applicant against the recovery warrant which has been issued in pursuance of the order dated 26.02.2024. In this conspectus, as above, I am of the considered view that no interference is required in the instant matter. Recovery warrant issued by the court concerned cannot be said to be in violation of any legal provision or abuse of process of law.
